These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. It is upon our sole discretion to offer account time period extensions free of charge and in no way are we obligated to provide such extensions free of charge.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Access to our Service is paid access and is not offered initially free of charge. Payment must be accepted and cleared before access to our Service will be granted. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability. Upon termination, your right to use the Service will immediately cease. Refunds and Pass Guarantee

Our pass guarantee policy extends to all our membership levels except as where prohibited by law. The pass guarantee is not in effect for the states of Florida or Tennessee as required by law, or any other state in which it becomes knowledge that such a guarantee is not applicable by law. In order to receive a refund of any monies paid, if you have completed the course and you do not pass your appraiser exam on the first try after fully completing our course and subsequently taking the exam within 30 days of completion of our course, you will be entitled to a full refund of the $39, $49, $59, or $69 enrollment fee, depending on which course you purchased. Fully completing our course means scoring at least an 80% or better on all the final mock exams available in our course. Failure to complete our course voids any pass guarantee or refunds and will not entitle you to any monies to be refunded. We may require you to send us an exam failure notice, our course completion certificate, or both before a refund can be processed. In addition, refund requests must be made within 30 days of any failed examination date. Refund requests will not be honored after 30 days of the date of the failed exam. After 30 days from course purchase, refunds will not be issued unless course has been completed and failure of the actual exam occurs within 30 days of course completion. Furthermore, after the twelve month membership period is completed, the transaction is considered completed and no refunds will be issued, unless the course had been fully completed prior and all aspects of the Pass Guarantee were met. Once a refund is given, access to the site and all membership data will cease. Once a refund is given the transaction is fully completed. There is no free trial period, test drive, etc. for any course and once a course has been accessed, no refunds are issued unless the course has been completed, failure of the state exam occurs within 30 days of completion, failure notice has been sent to us within 30 days of failure, and all aspects of the Pass Guarantee were met. Additionally, we reserve the right to issue refunds at our sole discretion.

Governing Law

These Terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. Any modifications can be seen on this page at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
